Who can use Excalibur

You must be at least 13 years old, and old enough to form a binding contract where you live. If you are using the Service on behalf of a company, you confirm you have authority to bind it.

Your account

You sign in with Google, Facebook, or Apple. You are responsible for keeping that provider account secure and for everything that happens under your Excalibur account. One account per person; do not share it or let anyone else use it. Tell us straight away at [email protected] if you think your account has been compromised.

What Excalibur is

Excalibur is an AI companion. You talk to it, it remembers, and over time it builds a record of who you are and helps you act on it through quests, habits, goals, and check-ins. The replies you receive, the Codex it builds, and the suggestions it makes are generated by AI models based on what you have told it.

AI-generated content is not professional advice

Excalibur will talk with you about anything, including your health, your mind, your money, your relationships and your work. What it says is generated by a machine. It can be wrong, incomplete, or confidently mistaken, and it does not know things it was not told.

Nothing the Service produces is medical, psychological, legal, financial, or other professional advice, and no professional relationship is created by using it. Use your own judgment, and talk to a qualified professional before acting on anything that matters. If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line now; Excalibur is not an emergency service and cannot call for help on your behalf.

Your content

Everything you put into Excalibur, and the Codex built from it, is yours. We claim no ownership of it. You give us the permission we need to store it, process it with our AI providers, and display it back to you, and to nobody else, so the Service can work. That permission ends when you delete the content or your account, except for copies in backups until those roll over, as described in the Privacy Policy.

You are responsible for what you upload. Do not put in material you do not have the right to use, or that belongs to someone who has not agreed to it being processed by an AI.

Acceptable use

Do not use the Service to:

• break the law, or help anyone else break it;
• harass, threaten, or harm another person, or generate material that does;
• upload malware, probe or attack our systems, or try to get around usage limits or access controls;
• scrape, copy, or resell the Service, or use it to build a competing product;
• reverse engineer the app or the way it works, except where the law says we cannot stop you;
• impersonate anyone, or let someone else use your account.

We may suspend or close accounts that do any of this. Where the breach is not serious we will normally warn you first.

Subscriptions and billing

Parts of the Service require a paid subscription. Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), not by us directly, and the price and term are shown in the store before you buy.

• Renewal. Subscriptions renew automatically at the end of each term at the same price unless you cancel at least 24 hours before the term ends.
• Cancelling. Cancel through your Apple ID or Google Play subscription settings. Deleting the app, or deleting your Excalibur account, does not cancel a subscription. Cancelling stops the next renewal; you keep access until the end of the current term.
• Refunds. Refunds are handled by Apple or Google under their refund policies. We cannot issue refunds for purchases made through their stores, but if you are stuck, email us and we will help you find the right place.
• Trials. If you start a free trial, it converts to a paid subscription when the trial ends unless you cancel before then.
• Price changes. If we change the price of your subscription, the store will tell you in advance and you can cancel before the new price applies.

Subscription status is synced between the stores and us by RevenueCat. We never see your card details.

Ending things

You can delete your account at any time from Settings → Delete Account in the app. Deletion is immediate and permanent; see the Privacy Policy for exactly what is removed.

We can suspend or terminate your access if you breach these terms, if the law requires it, or if we stop offering the Service. If we shut the Service down entirely, we will give you reasonable notice and a way to export your data before we do. Sections that by their nature should survive termination (your content, the disclaimers, the limitation of liability, and governing law) do.

Changes to the Service and these terms

The Service changes often; features are added, changed, and sometimes removed. We may also update these terms. When we make a change that matters, we will tell you in the app or by email before it takes effect, and update the date at the top of this page. If you keep using the Service after that, the new terms apply. If you do not agree with a change, stop using the Service and delete your account.

Our intellectual property

The Service itself, including the software, design, name and logo, is owned by Divine Weapon Inc. or its licensors. These terms give you a personal, non-transferable licence to use the app on devices you own or control, for your own use, and nothing more.

Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including about accuracy, fitness for a particular purpose, or uninterrupted availability. AI output in particular is not guaranteed to be correct. Some jurisdictions do not allow these exclusions, in which case they apply only as far as the law permits.

Limitation of liability

To the fullest extent the law allows, Divine Weapon Inc. and its officers, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service, even if we were told it was possible. Our total liability to you for all claims combined is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars (US$100). Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Indemnity

If a third party brings a claim against us because of content you uploaded or something you did with the Service in breach of these terms, you agree to cover our reasonable costs, including legal fees, in dealing with it.

App store terms

If you downloaded the app from Apple’s App Store, these additional terms apply because Apple requires them: this agreement is between you and Divine Weapon Inc. only, not Apple. Apple has no obligation to provide maintenance or support for the app, and is not responsible for any claim relating to it, including product liability, legal or regulatory compliance, intellectual property, or consumer protection claims. If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price; beyond that Apple has no warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you. You confirm you are not in a country subject to a US government embargo or designated a “terrorist supporting” country, and are not on any US government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when using the app.

If you downloaded the app from Google Play, Google’s terms of service and the Google Play terms also apply to your download and any purchase made through it.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved by talking to us first will be brought exclusively in the state or federal courts located in Delaware, and you and we each consent to their jurisdiction. If you are a consumer in a jurisdiction whose law gives you the right to sue in your home courts or under your local consumer law, nothing here takes that right away.

If any part of these terms is found unenforceable, the rest still applies. These terms, with the Privacy Policy, are the whole agreement between you and us about the Service. Our not enforcing a term is not a waiver of it.
